Who wants a Constitution ?

The Maha Sangha Rathnaya of the three Nikaya, the Majority of the Sinhala Buddhists and according to Bishop Rev. Malcolm Ranjith the Catholics of Sri Lanka do not want a new Constitution. Then who is it who wants a Constitution for Sri Lanka ?

Of all things that have to be done in Sri Lanka- Sri Lanka which is on the verge of facing an enormous  economic, social and political calamity which would erupt to blow up the very existence of Sri Lanka, and the worst natural disasters one following the other such as the severe droughts,  several floods that ruined the country and left people dead and homeless,  and today  which it faces the worst of all disasters  the  fall army worm which is spreading fast  destroying all agricultural plants from corn to rice, and perhaps attack the tea plantations as well, why a new Constitution ?

However,  Ranil Wickramasinghe like Nero  who played his violin while Rome was burning, seems to be unaffected  by all the dangers  the country is facing, and averse to opposition raised by the venerable Monks and reverend  Bishop, seems to be  going ahead unconcerned with his effort to realise  his Presidential dream by giving a Federal Constitution written and approved by Sumanthiran and his lawyers  of the Tamil Diaspora.

Abraham Sumanthiran of TNA, who is taking a greater interest in passing the new Constitution for the benefit of the Tamils is  in fact not even a real Hindu Tamil, but a low caste Christian Tamil. It is said that only  the low caste Tamils became Christians as they were not even allowed to go to a Hindu Kovil or recite Sanscrit Slokas.

It is  all these half Tamils that wants Sri Lanka divided.  Chelvanayagam who proposed Federalism was a Christian too.  And the present Governor of Northern Province Suren Raghaven who is against Buddhisisation (as he calls) of North is also a Christian.  Wignesvaran the mad reired Judge is however living with bats in his belfry.  But the Sri Lanka Judges are however seem to be influenced by Christianity and Evangelical Church of America which is behind Ranil Wickramasinghe  and Rosy Senanayake.  

Perhaps  even those  judges who denied the people of Sri Lanka their democratic right of using their vote at an election to change the disaster of being ruled by Prime Minister Ranil Wickramasinghe  also belonged, if not influenced by the Evengelical Churches in Colombo , helped Ranil to get re appointed as the Prime Minister.

A new Constitution is not essential for Sri Lanka specially under the Primiership of Ranil Wickramasinghe, who has proved himself to the people of Sri Lanka, as the most unreliable , untrustworthy politician who had thrice  in recent time taken  measures on his own to ruin Sri Lanka.

The first was as the Prime Minister of President Chandrika Kumaratunga when he signed  the CFA with the terrorist leader Prabhakaran, mediated by Solheim of Norway which allowed the terrorists to have  in the  North  areas under their control, allowing them to visit any part of the country, provided they did not carry guns ,  but not allowing any Government Official to enter the territories under the control of the terrorists.

The second betrayal of Sri Lanka was as the Prime Minister under President Maithripala Sirisena when he allowed a non citizen to be appointed as the Governor of the Central Bank and through him robbed Billions of rupees  from the Central Bank under a Bond scam.

The third betrayal is getting the Sri Lanka judiciary to stop the dissolution of Parliament  and got himself reappointed as the Prime Minister now  making all efforts to pass a Constitution prepared by the pro terrorists Tamils selling the rights of the Sinhala Buddhist majority of the Country for ever. Ranil Wickramasinghe as Prime Minister is helping Sumanthiran and Sambandan of  TNA to fulfil the dream of Prabhakaran.

A  Constitution of a Country is written by its indigenous majority population. No country gets its minority Community to write a Constitution for the Nation.

More over in the present exercise of preparing a new Constitution, Ranil’s government is not a popular government of the people elected by them, but a government usurped from the rightful people by a judicial manoeuvre. Therefore it  has no moral or legal right to prepare a Constitution for the Country.

Furthermore, the persons involved in writing the so called Constitution for the country are not trust worthy individuals. They are all in some way or other people with a criminal background. Ranil Wikramasinghe had been accused for maintaining torture camps in Batalanda, Lal Wijenayake  has also an  immoral past  it seems having copied at an examination and expelled from the examination hall, and Abraham Sumanthiran is an imposter, not being  a full fledged Tamil , as he is a Christian and his allegiance is not to the Hindu Religion of the Tamils of Sri Lanka, but to a foreign religion. 

Therefore they are all morally and legally unsuitable  dishonest people to write any document that decides on the future of  Sri Lanka with its long history and  its Sinhala Buddhist Culture, let alone writing a Constitution.

The 1978 Constitution lasted through out the worst period of terrorism in Sri Lanka and as the fear of a resurgence of terrorism is still not over, it is important to keep the Executive powers of the President,  though the fear of such powers in the hands of a man like Ranil Wickramasinghe  would be catastrophic. But the chances of his becoming a President of Sri Lanka is very little indeed.

Even the Government of the Prime Minister Ranil W is not  from recently elected MPs by the people, and the popularity of RanilW is reduced to a very small percentage of Colombians, the Muslims and Tamils. The  greater majority of the Sinhala Buddhists, and the Venerable Buddhist Monks are definitely against Ranil Wickramasinghe’s political leadership.

Therefore there attempt to present a Constitution in any form to the Parliament is questionable, and should be rejected by the Parliamentarians of all sides. The TNA the JVP and people like Champika, Kiriella, Muhabir Rahuman, Marikkar, and other UNP seniors and back benchers will want a new Constitution  but that is comparatively a small percentage of the population.

It is strange that,  it is the  political parties unpopular with the people at the moment that is presenting  a Constitutional to the Parliament . The TNA is not representative of the greater part of the country.  The JVP which has no popular following in the country and cannot get more than three or four MPs elected at a General election. They want  drastic changes to the present Constitution by introducing a 20^th Amendment.

These must be rejected as efforts by  unpopular political parties to create anarchy and through that to seize power if possible. The Parliamentarians of the left  and other well wishers of Sri Lanka should be alert  not to keep these trouble shooter of the UNP, TNA and JVP from engaging  foreign forces  to  intervene to divide the country. That seems to be the aim of the reactionary forces lead by UNP, TNA and JVP.

Prime Minister Ranil W, keeps lying to the public. Even after having presented a document which is apparently a Draft Constitution, RanilW says it is not a Constitution. But Sumanthiran says that the Constitution could be passed within a month as there is nothing to write as the document presented to the Parliament is in a Constitution format and it could be passed as it is (Hiru TV Salakuna 21 January,2019). Now who tells lies Ranil or Sumanthiran.

A new Constitution if ever to be written again should be written by the Sinhala Buddhists. The Tamil politicians should not have a say in the writing of it. Even the British when they wrote Constitutions for Sri Lanka gave the rightful place to Buddhism and foresaw to keep  unitary status of the Island.

The Tamils are not intelligent like the Black American minority in America or the Algerian , Vietnamien, and African minorities  in France. The Tamils have a savage Dravidian back ground ( with their traditional  worship of their Gods by hanging themselves in hooks  or rolling on the ground , and walk on fire ),  therefore more civilised rituals and Communal relationships cannot even be imagined by Sumanthirams, Sambandans, Senathirajans, Wigneswarans,  or Raghavans.  They will never create peace and harmony in Sri Lanka always wanting to be different.

Far too many concessions have been given to the Tamil by way of reconciliation, while the Tamil politicians have given nothing in return by way of appreciation  for the concessions that had been extended to them. Is it to satisfy such an ungrateful Community represented by these monstrous  Sumanthiran, Sambanthan, Senathirajans, Wigneswaran etc. that a new Constitution has to be passed  ?

The Secretary of Defence Hemasiri Fernando says that 11 Military Personnel are to be tried for war crimes  to please the Diaspora who would not thereafter  complain any more that no action had been taken against Military personal who had been accused for criminal offences. 

This has to stop.  In Afghanistan a group of American Soldiers killed Afghan Civilians just to cut off their fingers which they were collecting as souvenirs. No action were known to have been taken against these soldiers to please any one. The terrorists war is over , during terrorism many atrocities were committed  by the terrorists.

The armed forces did not commit any murder,  outside the military operations for the elimination of terrorism, there may have been killings which had not been accounted for. But it is time to forget that dark period of our history, and continue to live.  The Tamils can never be satisfied they will cry foul for ever, handing over their lamentations to the generations that follow.

The Tamils have made a profession of crying. In Kandyan homes I have heard that  they employed Tamil women to cry in homes when there was a death in the family, the Tamil women wail when ever people come  to pay their respect to the dead.

The Members of the Parliament if they have any patriotism towards Sri Lanka should reject the presentation of a Constitution or any thing that has any relation to a Constitution as a Draft, or a document in the initial stage of preparation of a Constitution.  The right thinking Parliamentarians with any intelligence should fall in line with the Parliamentary Opposition to get rid of  the government led by Prime Minister Ranil Wickramasinghe supported by the TNA,JVP etc.

Sri Lanka does not want Ranil Wickramasinghe or any likes of him forming a Government to rule this Country.

Yasmin Sooka Instead of hunting for war criminals in Sri Lanka try helping the poverty stricken blacks in South Africa.

In many townships, residents use plastic portable public toilets. 

Yasmin Sooka, have you visited the poor Africans living in squalid conditions in Squatter Camps, seen with your eyes the misery of the poor blacks living in shanties of Johanesbourg or the living conditions in Barcelona with strewn filth ?

I am sure not Sooka, because you only write reports sitting in comfortable offices or speak to well off  political leaders who do not understand human suffering, and to  NGO parasites living on the miseries of others.

                                            

Yasmin Sooka what has truth and justice you direct given to the poor  South Africans still living in utter poverty  and in inhuman misery.

Yasmin Sooka was a member of a UN Panel which prepared a faulty report on Accountability in Sri Lanka for the personal use of  UN SG Ban Ki Moon- the Darusman report. It was prepared depending on emails and hearsay evidence collected from files and members of  the Tamils living abroad, most of them had not been in Sri Lanka during  terrorism to even know what it was like.

The Tamil  diaspora has a burning prejudice against Sri Lanka and its  Sinhala majority.  The report was accepted by UN Commissioner for Human  Right Navi Pillai a Tamil herself who hero worshipped the terrorist leader Prabhakaran, to accuse Sri Lanka Armed Forces for war crimes,  during her period of service in the UNHRCouncil and passed it on to Prince  Zeid Al-Hussein  who continued repression against  the Government imposing on it  the notorious resolution by America and the West for human rights violation and war crimes.

Yasmina Sooka’s only connection to Sri Lanka is her member ship in the Darusman Panel and her  friendship with Navy Pillai sworn enemy of the Sri Lanka Government and its Armed Forces. Sooka  wants to be in the international “lime light” by jumping now and then to accuse for no valid reasons  the Officers of the Sri Lanka Armed Forces.   

She accused former General Jagath Jayasuriy  when he was in Brazil for war crimes and that he should be taken into custody while abroad.  The latest is her condemnation of the Government of Sri Lanka for the appointment of Major General Shavendra Silva as the Chief of Staff of the Sri Lanka Armed Forces.

She had said  speaking about Majaor General Shavendra Silva, “The military officer is arguably the most wanted man in Sri Lanka–yet a decade later, tragically, he is being promoted instead of standing trial. 

Tamil survivors of the war, thousands of whom have been driven into exile since, have expressed horror that Silva has been chosen for such a senior military position. This is an incredible affront to the victims of that war–and jeopardises any reconciliation attempt in Sri Lanka,”

What Yasmin Sooka does not know, or does not want to acknowledge is the fact that, had it not been for the likes of  the Chief of Staff Shavendra Silva, the Tamil civilian population in the North and East would have been driven like cattle  by the terrorists from place to place in the jungles of the north  to be kept as human shields for their protection.

That suffering of the poor Tamil civilians neither Yasmin Sooka nor the Tamil Diaspora will never ever understand.

The Government armed forces of Sri Lanka never fought against the Tamil civilians , but against the terrorists who were Tamils. If they fought against the Tamils  why did the Sri Lanka Armed Forces specially the Division 58 led by Major General Shavendra Silva evacuated 320 thousand Tamil civilians forcibly kept by the terrorists as a human shield  under most  inhuman sanitary conditions ?

This continued accusation of our  of the officers of the Armed Forces by Yasmin Sooka should stop.  It is a humiliation for a man  who took risks for himself and his men to end the suffering of all  the people of Sri Lanka. Humiliation of that one man is a humiliation directed to all the people of Sri Lanka.

Therefore, the Government of Sri Lanka should initiate some sort of action through the Secretary General of the UN to stop Yasmin Sooka taking on herself the role of a “world police woman” hunting  for war Criminals,  as she has no official position to make false accusations any Officer of the Armed Forces of Sri Lanka..

The Armed Forces of Sri Lanka are respected by the people of Sri Lanka. All those officers and member of the Armed Forces who took an active part in the elimination of terrorism and putting an end to 30 years of suffering more of the Tamils of the north and East and other Communities in the rest of the country outside the North and East, are our heroes and saviours of the country and the people.  How dare does  Yasmin Sooka continue to be ittle our heroes and treat them as having committed war crimes in their legitimate war against the terrorists the enemies of Sri Lanka and its people.

No body has the right to make vain accusations against them and least of all Yasmin Sooka who made a false report knowing that it was false,  to dupe the UN and satisfy the Tamils of the Diaspora.

Let us see why Yasmin Sooka meddles in  an affair that does not concern her, when after her participation in  writing the false Daruman reports, she became the Director of the International Truth and Justice Project. If she has real humanitarian interests, why doe not she turn to South Africa, her own country where life is  not so  rosy to the majority of the  black South Africans who live below the poverty line.  

Yasmin Sooka has a long list of Commissions and Panels in which she served and many  writings of  all sorts of reports, as well as  making speeches  at forums , but Yasmina Sooka has not actively participated, and actually engaged herself in any project to ameliorate the conditions of the poor people in South Africa, whose human rights are daily in conflict, with government officials and the rich and well to do.

There is however not that great poverty in Sri Lanka after elimination of terrorism but living conditions of the Tamils as well as the Sinhala and Muslims have largely improved. The Sri Lankans live happily  despite the interference by persons like Yasmin  Sooka and members of multifarious  NGOs working in Sri Lanka earning their living accusing the  Armed Forces of Sri Lanka, and political leaders of the Sinhala Community opposing the puppet Government set up by  the West,  lead by a Prime Minister supported by the West  and the NGOs.

Yasmin Sooka  is still sought  after by the Sri Lanka Tamil politicians of the TNA to continually accuse the Armed Forces, as they want anti Sri Lanka  Armed Forces publicity continued as they are planning to have a Tamil only Provinces in the North and East without Army Camps  after helping the Present Ranil Wickramasinghe Government to prepare a Federal Government which they are determined to get passed in Parliament .

The Tamil Politicians down play the Sri Lanka’s development after  the  elimination of terrorism. There were proposals to set up a Truth and Justice project in the line of South Africa and even suggestion to put up a statue of Nelson Mandela.

Nelson Mandela  is of course a man respected for his indefatigable fight against South African Apartheid  and actively engaged himself until  the end of the racial regime.  The South Africans should put up statues of Nelson Mandela every where in South Africa as a reminder that South Africans should not  allow themselves to suffer once again  because of the colour of  their skin.  

But Yasmin Sooka has apartheid been completely erased from South Africa ?

Yasmin Sooka open your eye and see the suffering of your people in South Afrika, instead of trying to create misery where there is none in Sri Lanka. The trouble with Sri Lanka is that the Tamil  Politicians are living in a mental state of segregation, and suffer through a racial difference created on their own.

In South Africa the wealth is not reasonably distributed and  the people still lack land and wealth and suffer from utter poverty, that Sooka is economic apartheid. It is for you to get involved to finish what Nelson Mandela began to  liberate people  completely  both from social and economic segregation. You cannot do that by accusing our armed forces which liberated its people completely from terrorism and gave the people peace and security which you have not given to your own people.

What action did you  take against reported high level  corruption of the  President Jacob Zuma’s Government , will things be better under Cyril Ramaphosa ?

A Statue of Nelson Mandela has no place in Sri Lanka, as Sri Lanka never had apartheid and the Tamil people were and are as free as the Sinhala, and other minority Communities living in Sri Lanka. The comparison to apartheid, genocide by the Sinhala are  stories concocted  by the Tamil politicians to keep the Communities  separated and create a separate Eelam State led by the high Caste Tamil politicians. There is no reason why we should have a Statue of a political leader of  South Africa who emancipated his people from apartheid erected in our country. It is the high caste Tamils who create “ apartheid  against the low caste Tamils in Sri Lanka, not the Sinhala who treat every one equal.

But we should have statues erected for the Armed Forces that freed the country and the people from terrorism. We should have a statue of Major General Shavendra Silva in Jaffna as it was Major General Shavendra Silva and his 58 Division that led its assault against the terrorists to liberate 320 000 Tamil Civilians kept as human shields under repressive condition without prper sanitary conditions, food , water or even clean clothes to wear.

South Africa unlike Sri Lanka is a country with great potentials for development. It is, better than many other African States but still second to Nigeria in development.  But the wealth as much of the land is in the hands of the rich white population.  While not only the poor blacks but well  over 400 000 white south Africans are living in poverty in squalid conditions in squatter camps. This is being challenged by some white media reporters as they do not want to put the poverty stricken whites along side the blacks.

 Education system is much to be desired. The schools have no adequate  space and the Principles of Schools are corrupt squandering money from school accounts. The private schools are better, but the poor cannot afford to send their children to them  There is no teacher training . Parents yearn to have their children educated but they cannot afford to do so.  The gap between the rich and the poor is far greater. Tin and mud shacks in which the poor live in squalid conditions jostle besides luxury mansions of the rich. Health Care in South Africa is low and not within the reach of the poor blacks.

There is an increasing crime rate , and never ending streams of immigrant coming from countries in the rest of Africa. The government puts the increasing crime rate  to the inflow of  immigrants.

The South Africa has been nominally freed from apartheid , but the black Africans have not been freed from economic  apartheid as yet . The Indians and others like Yasmin Sooka are better off than the native Africans , but being better off Yasmin Sooka is interested in doing service to Tamils in Sri Lanka and not helping the  poor black Africans who need every ones help to find their way out of poverty.

I give some internet references below to educate Yasmin Sooka what her duties should be as a South Africans. She should leave her interest in looking after the interest of Tamils in Sri Lanka and  ask her self how to help her own people suffering in South Africa, as they are worse off than the Tamils in Sri Lanka.

13 November 2018 darkest day of Sri Lanka’s 2600 year history when Supreme Court deprived people their right to change a repressive Regime.

The 13^th November, 2018 the Supreme Court of Sri Lanka,  against the advice of the Attorney General, issuing a stay order  for the dissolution of Parliament and calling for General elections by the President of Sri Lanka was the darkest day of Sri Lanka’s 2600 years old history.  Because that Supreme Courts stay order deprived the  people, who had suffered economically, socially and culturally for three and a half years,   the only occasion they had to change  the most  repressive government there ever was in Sri Lanka  dominated by Ranil Wickramasinghe and his UNP, supported by the Tamil National Alliance and Janatha Vimukthi Peramuna.

If the Supreme Court had not contributed to the disaster that followed their unwise decision, there would have been a General Election on the 5^th January,2019 and the people would have  got rid of a repressive government and replaced it with a government of  their’ choice.

That would have avoided the Ranil Wickramasinghe- Sumandiran Government preparing a new Constitution and forcing  it to be passed in parliament to drive the final nail in the coffin, (where the 2600 year old Sri Lanka with its Buddhist culture that nurtured a nation, with  Theravada Buddhism- a beacon of  light  that could  save the world from falling into a dark age of  human suffering,  repression,  crime and savagery), which would be laid to rest.

With the end of Sri Lanka, Orumitta Nadu (in the internet Sri Lanak is already called Oruma Nadu) will replace it. A  new order would be organised by Tamil National Alliance building their Tamil Eelam State- the dream with which the terrorists perished in 2009.

Janatha Vimukthi Peramuna would be the lackeys of the Capitalist UNP in the south making the people slaves living on the crumbs falling from the tables of these political criminals.

The Supreme Court  should not have  issued  the interim order  Staying the Gazette Notification for the dissolution of the Parliament,  as President Sirisena had acted in good faith in the interest of the country and the people. The President’s intention was  to find relief for the people from a repressive Government led by Prime Minister Ranil Wickramasinghe who had politically  disabled the President with the introduction of the 19 th Amendment.

The Prime Minister  Ranil W  is a  double faced hypocrite, who duped the President right from the beginning robbing the Central  Bank, signing  contracts with other countries without any prior consultation with  the President or the  Parliament.  Ranil Wickramasinghe  had the 19^th Amendment to the Constitution  prepared by his  Western allies who  had couched it  in terms hiding the true effect of the amendment. Thereafter it was convenient for Ranil W the Prime Minister to usurp the powers of the President for himself.

In this great betrayal of the people by the Ranil Wickramasinghe on the 26^th October, 2018, when he was Constitutionally removed from the office of Prime Minister, he   illegally occupied the Temple Trees housing it with all his local  thugs and foreign supporters and rebelled against the President. 

President Sirisena  who had had enough of his misdeeds had been waiting for a chance  to rid of him. The chance came when the UPFA faction of the Yahapalanaya informed the Speaker that it was leaving the coalition. Hence, with the split of  the Yahapalanaya Cabinet,  the Prime Minister according to the relevant Article of the Constitution lost his office of Prime Minister.

It was then that the President Sirisena called  Mahinda Rajappakse- against whom he played  the key role to defeat him at the Presidential Elections in January,2015, to take over the Office of  Prime Minister,  as he knew Mahinda Rajapakse  was nevertheless an honest and a capable man to save the country from the precipice of disaster  Ranil Wickramasinhghe was trying to roll it over.

Everything had been in order according to the Constitution. But these facts had been ignored by the wise judges of the Supreme Court, when they examined the 13 FR applications against the gazette notification issued  by the Presidents for the  dissolution of Parliament and call for General Elections.
The People who had suffered for three and a half years under the heavy economic burdens put upon them by the Yahapalanaya Government came out spontaneously to rejoice the change and Mahinda Rajapakse they loved being appointed as the Prime Minister.

Under these circumstances one cannot still understand how it was that the Supreme Court ignored the Article 33 of the Constitution, as against Article 70. The 19^th Amendment had not removed it, or  those who drafted the 19the Amendment did not see the importance of the article 33 ( or simply forgot to remove it), therefore the Article 33 remains legally in force to mitigate the effect of the article 70 which rules out the dissolution of the Parliament  for four and a half years, which is against all democratic parliamentary norms.  

Hence the President Sirisena  in using Article 33 as an emergency exit after having removed the Prime Minister to  dissolve the Parliament and call for  a General election was  acting  legally  and within his Constitutional right. That was why even the Attorney General correctly advised the Supreme Court to reject the 13 FR applications against the Presidents dissolution of the Parliament and calling of elections as unacceptable.

These are some of the reasons why even the people  begin to question whether, as much as  Ranil Wickramasinghe, his UNP and its allies, the TNA and the JVP were partners in this great betrayal to deny the people their democratic right of electing a new set of Parliamentarians at a General election, whether the Supreme Court too had a hand in it,  in issuing  an interim order against the  dissolution of Parliament by the President as illegal.

The courts take shelter under legal immunity and independence , to  allow the country to be destroyed by a government acting bereft of patriotism,  proved to have  other interests than the welfare of the people. The courts should be independent of the executive and the legislature but not independent from the people.

That is why the appeal court order which stopped the Prime Minister Mahinda  Rajapakse and his Cabinet of Ministers  from functioning on the ground  explained in  confusing verbiage, that they are irresponsible and they cannot be trusted to take irrevocable decisions, is not comprehensible.

Were the judges  really acting on their own or were they being influenced by unknown “Divine”  forces to make them understand that  Mahinda Rajapakse is an irresponsible politician despite his saving the country from ruthless terrorism, and  that he cannot be trusted governing as  Prime Minister despite his having  been the President of Sri Lanka twice and remains loved and respected by a large majority of Sinhala Buddhists of the country ?

 And where is Sri Lanka in the meantime with pseudo democracy and an independent Judiciary  ?

In 1933 Pearl S.Buck won the Nobel Prize for literature for  writing brilliant novels such as The Good Earth  describing the poverty of the Chinese peasants. She described  in moving terms  how the Chinese peasants who had no food to eat survived eating barks of trees , and how the peasant  women sold little babies on the way side. 

Later the western press described  how Mao’s Communism  massacred its own people, and later how the Communist governments violated human rights of the Chinese people. When the west triumphed  in breaking up the powerful USSR, they thought they would follow it up with China and erase  Communism from the face of earth.  

In 1989 the Chinese Students manipulated by interested parties  came out in thousands to manifest against the Chinese Communist Regime. The American and the Western press overjoyed rushed  in  to take images of floundering Communism to show the Americans to rejoice the end of Communism in China, and the victory of Western democracy.  However, the government of the People’s Republic of China  suppressed the students manifestation  which the western press immediately flashed  in large letters in the first pages as the Tiananmen Square Massacre.

America took away the student leaders who led the manifestations as heroes of democracy. The Western press described in details  to shock the American public the suppression of the student manifestations as brutal  and the massacre of thousands of Students . American Government as usual suspended arms sale to China, and imposed economic sanctions.

Thereafter, at every international forum America and the West condemned China for violation of human rights, and it became their preoccupation for a number of years continuing to do so even now. However, despite refusal of the West to transfer science and  technology, China which had begun its development process in stages first by even melting  iron ore in home furnaces, rose from the state  of poverty, despite  American and Western barriers for its development with  anti China propaganda, and  yet as if it were overnight  became the economic leader of the world, second only to that of the America.

When in 1969 the Americans landed the Spacecraft Apollo II on the moon, while relations between China and Russia had turned sour and there was conflict brewing between the two- the Dragon and the Bear, in 1969 China celebrated its 20^th Anniversary of Mao’s declaration of the People’s republic of China on 1^st October,1949.

To crown it all on the 4^th January, 2019,  China Landed a spacecraft on the dark side of the Moon, the side unseen from the earth.  That is a first by China and perhaps a slap on America with Trirmph’s declared trade war against China. But the West are not generous even to accept such a great achievement of China. France television  while discussing this great Chinese achievement  shamelessly questioned on  China’s  violation of human rights. America and Europe are hopelessly involved in a political and an economic  crisis- America with a President who does not seem to know what he has to do, UK has problems with regard to entering or leaving the EU, France in a political stand still with thousands of people on the streets  protesting against taxation,  Germany’s political crisis over immigration. Italy in the hands of extreme rightwing politicians with a crisis over EU, all that while China sails peacefully on a  calm sea  bereft of rough political waves towards greater  hope and prosperity.

The Chinese people were able to recognise their President Xi Jinping  elected by them on the 15^th November,2015  as the  man capable of leading their country forward to success, and  elected him  as their  President for life on 25 October,2017.  That is how countries could prosper. Russia too found a great leader in  Vladimir Poutine and continues to elect  him term after term  to develop Russia further  as he is  loved by  the Russian people and earned their confidence.  .

We in Sri Lanka should also have re-elected Mahinda Rajapakse and kept him as the President for  few more years, as in him Sri Lanka found the correct political leadership to lead the country to prosperity. All scandals started by UNP dictated to by the West about Mahinda Rajapakse being a corrupt politicians were all lies  because he was a great patriot who was in the service of the people and the country. It is still the educated Colombians, UNP and the Tamil politicians  that are a barrier to Sri Lanka’s development and prosperity. 

Not understanding this reality deprived Sri Lanka the services of a great political leader , as it has been proved today how wrong the people were  in electing another President to replace Mahinda Rajapakse for a change,   which brought back an incapable political leadersip under a Ranil Wickramasinghe a puppet of the West,   politically blind to lead Sri Lanka any where towards development.

RanilW has taken  Sri Lanka many miles backwards on the path of development that was traced by Mahinda Rajapakse. They accused Mahinda Rajapakse  for a family regime having his brothers around him, but those brothers  were an essential part of Mahinda Rajapakse’s equipment for his vision of development. 

America and the West  mindful  that wide powers  of exploring the space  vested with  people with special qualities, wanted to guard that knowledge for themselves. Hence America  did not pass on scientific and technological know how to China, as such knowledge they thought  requires making important decisions which will affect the whole world  and most of such decisions may not be reversible to make.

This sounds same as those wise words of Sri Lanka’s appeal court  judgement in which the judicial duo said to be independent  democratic appeal court judges, said why they cannot entrust the function of the duties of  a Prime Minister  and Cabinet of Ministers to a group that had been sworn in by the President of Sri Lanka.

No one can stop China reaching greater heights in  all fields of development. Sri Lanka should take a lesson and elect a visionary leader as a President of Sri Lanka, or while China goes from prosperity to prosperity we in -Sri Lanka,  with our pseudo democracy and pseudo independent Judiciary is  going down from poverty to poverty.

It is  time that the people take note and end this nonsense of  Sumandiran- Ranil Wickramasinghe Regime- for that is what it has become with their determination to pass a new  federal Constitution, with nine provinces, allowing JVP to present a 20th Amendment to the Constitution to have a President for Sri Lanka elected no more by the people, but by the Parliamentarians of no-confidence motion with 122 votes fame, allowing North and East to form a Single Tamil only Province, enact the Trade Agreement with Singapore and ruin Sri Lanka making it a puppet state of the West.

Sri Lanka cannot go to the Moon. But Sri Lanka has to preserve its territorial integrity, without allowing it to be  divided by a power crazy UNP and its allied political parties, to please  a handful of racist Tamil  politicians. Therefore  , the patriotic Sri Lankans should determine never  again to vote for any one from UNP or from its  allied parties for them to form a government or be party to a coalition government

දින 51 ක් බලපොරුත්තුවෙ හිරුඑලියෙන් සතුටට පත්වූ ජනතාව දෙසැම්බර 13 වනදා විනාශයට ඇද දැමුවාට වගකියන්නේකවුද ?

සමහරක් ඇන් ජී ඕ කාරයොයි ජනතාවිමුක්ති පෙරමුනේ ගොයියෝයි එක අච්චුවේ වක්කරපු රුකඩ වගේ. උන් ඔක්කොම දැන් කතාකරනවා  ඔක්තෝබර් 26වැනිදායින් ආරම්භ වී දෙසැම්බර් 16 වැනිදා දක්වා දින 51ක කාලය අඳුරේ විනාශයක් බවත්  ඒ යුගයට වග කිව යුත්තන් සොයා ඒ අයට විරුද්ධව නීතිමය කටයුතුතු කලයුතුබව.

ඇන් ජී ඕ කාරයොයි ජනතාවිමුක්ති පෙරමුනේවිනාශකාරී මාර්කස් වාදියෝයි  හිතාගෙන ඉන්නේ ස්වාධීන කියාගන්න  අභියාචනාධිකරණයෙ  හා ශ්‍රේෂ්ඨාධිකරණයෙ නඩුකාරයෝ උන් ගෙනයන විනාශකාරී දේශපාලනයේ සහකරයෝ හැටියටයි.  ජනාධිපති සිරිසෙන මැතිතුමාට  හෝ මහින්ද රාජපක්ෂ මැතිතුමාට විරුද්ධව නඩු පැවරුවොත් ඒ  නඩුකාර මඩුලු  අනුමානයක් නැතිව ඔවුන්ට විරුද්ධව නීතිමය ක්‍රියාවක් ගැනීමට සුදානම්යයි ඇන් ජී ඕ කාරයොයි ජනතාවිමුක්ති පෙරමුනේවිනාශකාරී මාර්කස් වාදියෝයි  හිතා සිටිනවා.  

ඇන් ජී ඕ හා ජනතාවිමුක්ති පෙරමුනේ රුකඩයෝ  කියන්නේ මේ 51 දවසක කාලයේ සිදුවුයේ සම්පූර්ණයෙන්ම ජනාධිපති මෛත්‍රීපාල සිරිසේන නිර්මාණය කල අර්බුදයක් කියල. අපි මේ ලිපියට ගත්තේ කේ ඩබ්ලියු ජනරංජන කියන  ඇන් ජී ඕ රූකඩයෙක් ඔවුන්ගේ පත්තරයකට ලියපු ලිපියක්.

ඇත්ත වශයෙන්ම ලංකාවේ අධිකරණය දෙශීය  නීතියත් ජනතාවත් අතර ඇති සම්භන්ධය අවභෝධකරනොගත් නීතියේ අකුරුවල හැංගිලා ඉන්න නීතියේ මානුෂික දර්ශනය ගැන හොයාබලන්න නොදන්නා  සමාජයෙන් ඈත්වුනු මිනුස්සු කොටසක්.

මෙය ලියන මා එංගලන්තයේ ලින්කන්ස් ඉන් නමැති නීති සමාජයේ බැරිස්ටර් වරයෙක්කමි. එහිදී නීති ශිෂ්ෂයන් වශයෙන් අපි  වින්ඩ්සර් පාර්ක්හි පිහිටා තියෙන චේම්බර් ලොජ් හි සමහරක්  සති අන්තවල හමුවෙනවා. එහිදී එංගලන්තයේ ප්‍රසිද්ධ ලෝර්ඩ් ඩේනින් ලෝර්ඩ් රස්සෙල් වැනි විනිෂචයකාරවරුන් අපට නීතිමය දේශනා පවත්වනවා. 

ඔවුන් අපට නිතර කිවූ දෙයක් තමා නීතිය හැදෑරුවායින් පසු නීතියට අදාල පසුබිම සෙවිය යුත්තේ නීතිය අදාලවෙන මිනිසුන්ගෙන්, ඔවුන් ජීවත්වන පරිසරයෙන්  කියලා, කෙනෙක් වරදකරුවෙක් වශයෙන් උසාවියට ඉදිර්පත්කලාම  ඔහු වරදකාරයෙක් හැටියට බලන්න එපා.  ඔහු ඒ වරද කිරීමට පෙලම්බවුන හේතු හොයන්ට කියල ඔහු හැදුණු පරිසරය බලන්න කියලා. නීතියේ අකුරට යටනොවී එයින් පැනනගින මානුෂික ප්‍රශ්න මොනවාද හොයන්න ඕනේ.

අපේ අධිකරණය එතරම් උසස් ව හිතලද තීන්දු ගන්නේ? එතරම් විශිෂ්ට නීතිමය තීරණ ගැනීමේ දක්ෂතාවයක් බවක් මෑතක  අභියාචනාධිකරණයෙ  හා ශ්‍රේෂ්ඨාධිකරණයෙ විනිසුරු මඩුලු ජනාධිපතිතුමා පාරලිමේන්තුව විසුරුවීම පිළිබඳව  හා පාරලිමේන්තුව නාඩගමක්කරගෙන  පාර්ලිමේන්තු මන්ත්‍රීවරු 122 ඉදිරිපත් කල විශ්වාෂභන්ග යෝජනාව පිළිගෙන කරපු  නීති විපර්යාශයෙන් එහෙම අධිකරන දක්ෂතාවක් දුටුවෙ නෑ.

නඩුතීන්දුවක් විවේචනය කිරීමේ  හෝ ප්‍රෂනකිරීමේ අයිතියක් හැම කෙනේකුටම තියනවා. 2018 දෙසැම්බර 13 වනදා ශ්‍රීලංකා ශ්‍රේෂ්ඨාධිකරණයෙ නව දෙනෙකුගෙන් යුත් විනසුරු මඩුල්ල  දුන් නඩුතීන්දුව මුලුලොකයේම ව්‍යවස්ථාව පිළිබඳව දුන් නඩුතීන්දුවල ඉතාමත් අපැහැදිලි ජනතාවගේ ප්‍රජාතන්ත්‍ර අය්තිවාසිකම් උදුරාදැමු ලකා ඉතිහාසයේ කළු අකුරෙන් ලියවෙන නඩුතීන්දුවකි.

ශ්‍රී ලංකා ව්‍යවස්ථාවේ 19වන සංශෝධනය නිසා  ව්‍යවස්ථාවේ පෙරතුබු වගන්ති අවලන්ගුවී නොමැත. එබැවින් අලුතින් එක්කරනලද සංශෝධනයක් පරික්ශාකිරිමෙදි අවශ්‍යයෙන්ම ව්‍යවස්ථාවේ අනිත්  වගන්ති  කොතරම්දුරට සංශෝධනවලට බලපානවාදැයි බැලීමට  මොලයක් ඇති ඕනෑම නීතීඥ වරයෙකු දැන සිටිය යුතුය.

19වන සංසෝධනයේ 70වන වගන්තිය  සම්පුර්ණයෙන්ම අපි දන්නා  ප්‍රජාතන්ත්‍රවාදයට පටහැනිය. සම්පුර්ණ 19වන සංශෝධනය  සකසා තිබෙන්නේ රනිල් වික්‍රමසිංහ සහ ඔහුගේ අනුගාමිකයන් විසින් රාජපක්ස පවුලට දේශපාලනයට නැවත පැමිණීමේ දොරටු  වසාදමා එක්සත්ජාතිකපක්ෂයේ ආඥාදායකත්වයක් ස්ඨාපීත කිරීම සඳහාය.

එහි එන 19වන සංශෝධනය අවුරුදු  හතරහමාරක් යනතුරු මැතිවරණයක් පැවතිවිය නොහැකිය යන 70 වන වගන්තිය  ලෝකයේ කොයි රටකවත් නැති ප්‍රජාචන්ද්‍රවාදයට පටහැනි වගන්තියක්.  

එයින් මිදී අපි දන්න ප්‍රජාතන්ත්‍ර වාදය නැවත ජනතාවට ලබාදීමට තුබු 70 වන වගන්තියෙන් වාරනයකළ නොහැකි  33වන වගන්තිය ජනාධිපතිතුමන්ට දේශපාලන අර්භුධයකදී ජනතාවගේ ස්වාධිපත්‍යයට ඉඩදී මැතිවරණයකට යාමේ එකම බලය පවත්නේ මේ 33වන වගන්තියේය.

මෙය දුටු නීති දෙපාරතමේන්තුවේ නීතිවේදීන් ජනාධිතුමා පාරලිමේන්තුව විසුරුවාහැරීමට ගත් තීරණයට විරුද්ධව ගොනුකළ විරෝධතා අහකදැමිය යුතුය යන නිර්දේශය ශ්‍රේෂ්ඨාධිකරණයට ඉදිරිපත්කලේය. නමුත් ශ්‍රේෂ්ඨාධිකරණයෙ විනුසුරුමන්ඩලයට එය අවභෝධකරගැනීමට අපහසු බවයි ඔවුන් දෙසමබර  13වනදා ඒ විනිශ්චය  විනසූරු මඩුල්ලේ එක  බාධක මොලයක්  අවුරුදු හතරහමාරකට විසුරුවන්නට බැරියයි මහා හයියෙන් කීයන අතරමගම  ප්‍රකාශයට පත්කළේ .

මේ විනිසුරු මන්ඩලය හිතන්න ඇති ඒ නඩු තීන්දුව පරාජයකලේ ජනාධිපති සිරිසේනගෙයි මහින්ද රාජපක්ෂ මහතාගේයි බලාපොරොත්තු යයි කියා  වෙන්න ඇති.  නමුත් එයින් පරාජයට  පත්වුයේ අර නඩුකාරයන් වැඩිය හිතන්නේනැති ලන්කාවේ වැඩියක් සිටින  අවුරුදු තුනහමාරක යහපාලනය නිසා අගහිගකමින් මිරිකී දුකින් සිටි දුප්පත් ජනතාවගේ බලාපොරෝත්තු බව ඒ නඩුකර හාමුදුරුගොල්ල නොදත්තෝය.

මේ ඇන් ජී ඕ හා ජනතාවිමුක්ති පෙරමුනේ රුකඩයනට රට දැය ආගම ගැන හැගීමක් හෝ  අවුරුදු තුනහමාරක යහපාලනය නිසා අගහිගකමින් මිරිකී දුකින් සිටි දුප්පත් ජනතාව  ගැන සොයාබැලීමට උවමනාවක් නැත.

ඇන් ජී ඕ රුකඩයන්ට නම් මහජනතාව ගැන කැක්කුමක් ඇත්තේම නැ. උන්ට උවමනා විදේශිකයන්ට හා දේමළ දයස්පොරාවට කත් ඇදීමයි. ජනතාවිමුක්ති පෙරමුනේ මාර්කස් වාදියෝ උන්ට බලයට එන්ට කදීම අවස්තාවක් පහලවෙලා තියෙනවායයි සිතාගෙන බලලෝභයෙන් අන්ධවෙලා 20 වන සංසෝධනයක් කරපින්නගෙන දෙමල සන්ධානයයි එක්සත් ජාතික පක්ෂයයි එක්ක කරන බලය තහවුරු කර  ගැනීමේ වැඩපිළිවෙල නිසා පීඩාවිඳින ජනතාව ගැන සොයාබැලීමට වෙලාවක් නැ.

මේ අධමයන්ට  රටේ  ජනතාවගේ හිතුම් පැතුම් ගැන අබමල් රෙනුවකතරම් වත් දැනීමක් නැ. ඒ නිසයි මුන් කියන්නේ ඔක්තොම්බර  26වනදා පටන් ගෙන දෙසැම්බර 13වනදා අවසන්උන දවස් 51 අඳුරේ විනාශ උන  කාලයක් කියන්නේ.

 අවුරුදු තුනහමාරක් තිස්සේ මේ රට අගාදියට ඇද දමමින් බැංකු මංකොල්ල කාගෙන ජනතාවට බදුබර පටෝලා,රටේ ආදායම් මාර්ග විකුනල, රටේ ආරක්ෂක හමුදාව යුදාපරධකාරයෝ හැටියට ඇමෙරිකාවට පාවාදීල,සින්ගප්පුරුවත් එක්ක වෙළඳ ගිවිසුමකින් අපේ රට ලෝකයේ කුණුකසල ගොඩබාන දුපතක් බවට පත් කරලා,  රටේ ෆෙදෙරල් ව්‍යවස්ථාවකට පාරකපල,  බුද්ධාගම නැතිකරලා, රට අදුරුයුගයකට ඈදදාළ කරගෙන ගිය වැඩපිළිවෙල නවත්වන්න ඔක්තොම්බර 26වනැ දා ගත් පියවර පෙරලා අධිකරණයත් නොමග යවාගෙ රට විනාශයට පත් කරන එකද ඇන් ජී ඕ හා ජනතාවිමුක්ති පෙරමුනේ රුකඩයෝ  රනිල් වික්‍රමසිංහගේ නැවත අගමැති වීමෙන් ලැබුවා කියන ඔවුන්ගේ ප්‍රජාතන්ත්‍ර වාදී නිදහස ?

 අපේ රට විනාශකරන්න විදෙශිකයින්ගෙ ඩොලර් සල්ලි වලට  රටට ද්‍රෝහිකම්  කරන ඇන් ජී ඕ හා ජනතාවිමුක්ති පෙරමුනේ රුකඩයෝ  ඔක්තොම්බර 26 වනදා සිට ජනතාව ලද නිදහස බෙල්ල තදකරන මිනිහෙක් ඒ මිනීමරුවාගෙන් බෙරාගත්තාම ලබන නිදහසක් මරණ බියෙන් මිදීමෙන් ලබන සහනයක්  හා සමාන සතුටක්  ඒ ඔක්තොම්බර 26වනදා මහින්ද රාජපක්ස මැතිතුමා අගමැතිවෙලා එ විගසම ජනතාවට ලබා දුන්න සහන ගොඩ නිසා එදා ජනතාව ලැබුවා.  ඒ සතුට  ජනතාවට ඇති උනෙ ආයෙත් නිදහසේ  සතුටින් ජීවත් වීමට සහනයක් ලැබුනාය යන බලාපොරොත්තුව ජනතාව තුල ඇතිවීමෙන්. 

නමුත් මේ ඇන් ජී ඕ හා ජනතාවිමුක්ති පෙරමුනේ අධමයන්ට පෙනෙන්නේ ඔක්තොම්බර  26වනදා ලැබුවේ අඳුරු කාලයක් හැටියට. ඒ අදුරුකාලය ඇත්තෙන්ම ලැබුනේ ඇන් ජී ඕ හා ජනතාවිමුක්ති පෙරමුනේ උන්ටයි. උන්වගේම අධම අධිකරණයක් නිසා එදා අපේ රටේ ජනතාව ලැබූ සතුට කෙටිකාලකට සීමා උනා.

එදා ශ්‍රේෂ්ඨාධිකරණයෙ නඩු තීන්දුව ජනතා පක්ෂපාතී තීන්දුවක් වුයේ නම් අද පවතින දෙශපාලන අර්භුධ හා  වෙන්ටයන රටේ විනාශය ගැන කිසුදු බයක් නැතිව ජනතාවට අවශ්‍ය සහනාධාර ලබාදී රට යන දේශද්‍රෝහි,  විනාශකාරී මග වෙනස්කර  නැවතත් රටේ සාමය, ආරක්ෂාව ඇතිකර  දියුණුවේ මාර්ගයෙ  යනගමනක සළකුණු පිබිදෙන්නට ඉඩ ප්‍රස්තාවක් තිබුණි.

එක්සත් ජාතික පාක්ෂිකයෝ මහා හයියෙන් කියනවා උන්  ලංකාව ලෝකයේ පිළිගත් රටක් කලාය ප්‍රජාතන්තන්ත්‍රවාදය ස්ථාපිත කලාය අධිකරණය ස්වාධිනකලාය කියල නමුත් ඔවුන් ප්‍රජාතන්තන්ත්‍රවාදය කෙලෙසුවා මෙන්ම අධිකරණයත් ඔවුන්ගේ මෙවලමක් කරගෙන ඇති බවනම් මුළුමහත් ජනතාවම දන්නවා. 

පාර්ලිමේන්තුව විසුරුවාහැරලා චන්දයකට  ගියානම් එක්සත් ජාතික පක්ෂය පරදින බවත් රනිල් වීක්‍රමසිංහට නැවත අගමැතිවෙන්න බැරි නිසාත් එක්සත් ජාතික පාක්ෂිකයෝ කියන නිදහස් අධිකරණය පුංචි උපකාරයක් දුන්බවක් තමයි අපි දෙසැම්බර 13වනදා දුටුවේ.  තවත්  අභියාචනාධිකරණයෙන් නඩු තීන්දුවක්
